Article 1 (Purpose)
The purpose of these terms and conditions is to prescribe the rights, obligations, and responsibilities of cyber
malls and users in using Internet-related services provided by Pure Korea (hereinafter referred to as "Mall")
operated by Pure Korea (e-commerce business operator).
※「These terms and conditions apply mutatis mutandis to e-commerce using PC communication, wireless, etc., as long as they are not contrary to their nature.」
Article 2 (Definitions)
① The term "Mall" means a virtual place of business established by Pure Korea to trade goods, etc. using information and communication facilities such as computers in order to provide goods or services (hereinafter referred to as "goods, etc.") to users, and shall also be used as a meaning of a business operator operating a cyber mall.
② The term "user" means a member or non-member who accesses "Mall" and receives services provided by "Mall" under these terms and conditions.
③ The term "member" means a person who has registered as a member of "Mall" and is able to use the services provided by "Mall" continuously.
④ The term "non-member" means a person who does not join a member and uses the service provided by "Mall".
Article 3 (Description and explanation and amendment of terms and conditions, etc.)
① "Mall" shall be posted on the initial service screen (front) of 00 Cyber Mall so that users can easily understand the contents of these terms and conditions, the name of the trade name and representative, the address of the business office (including the address of the place where consumer complaints can be handled), telephone number. Simulation transmission number. E-mail address, business registration number, mail order business report number, personal information protection manager, etc. shall be posted on the initial service screen of 00 Cyber Mall. However, the contents of the terms and conditions may be viewed by users through the connection screen.
② "Mall" shall seek the user's confirmation by providing a separate connection screen or pop-up screen so that the user can understand important contents, such as withdrawal of subscription, liability for delivery, and terms of refund, etc., among the contents prescribed in the terms and conditions before the user agrees to the terms and conditions.
③ The term "Mall" may be amended to the extent that it does not violate the relevant laws, such as the Act on Consumer Protection in Electronic Commerce, etc., the Act on the Regulation of Terms and Conditions, the Framework Act on Electronic Documents and Electronic Transactions, the Electronic Financial Transactions Act, the Electronic Signature Act, the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc., the Act on Door-to-Door Sales, etc., and the Framework Act on Consumers.
④ Where "Mall" amends the terms and conditions, it shall be announced on the initial screen of the mall along with the current terms and conditions from seven days before the application date to the day before the application date: Provided, That where the contents of the terms and conditions are changed unfavorably to the user, the notice shall be made with at least 30 days of advance grace period. In such cases, "Mall" shall clearly compare the contents before the amendment with the contents after the amendment and mark it so that the user can understand it easily.
⑤ If "Mall" revises the terms and conditions, the revised terms and conditions apply only to contracts concluded after the date of application, and the terms and conditions before the amendment apply to contracts already concluded before that date. However, if a user who has already signed a contract sends the intention of being subject to the terms of the revised terms and conditions to "Mol" within the notice period of the revised terms and conditions under paragraph (3) and obtains the consent of "Mol", the terms and conditions of the revised terms and conditions will apply.
⑥ Matters not prescribed in these terms and conditions and interpretations of these terms and conditions shall be governed by the Consumer Protection Act in E-Commerce, the Regulation of Terms and Conditions, the Consumer Protection Guidelines in E-Commerce, etc. prescribed by the Fair Trade Commission, and related laws or regulations.
Article 4 (Providing and changing services)
① "Mall" performs the following tasks.
1. Provision of information on goods or services and conclusion of a purchase contract
2. Delivery of goods or services contracted for purchase
3. Other duties prescribed by "Mall"
② "Mall" may change the contents of the goods or services to be provided by a contract to be concluded in the future, in the case of out-of-stock goods or services or changes in technical specifications, etc. In such cases, the details of the changed goods or services and the date of provision shall be specified and immediately notified to the place where the current goods or services are posted.
③ If the contents of the service contracted with the user to be provided by "Mall" are changed for reasons such as out of stock of goods, etc. or changes in technical specifications, the reason shall be immediately notified to the user at an address where the user can be notified.
④ In the case of the preceding paragraph, "Mall" shall compensate for the damage suffered by the user: Provided, That this shall not apply where "mole" proves that there is no intention or negligence.
Article 5 (Disruption of Services)
① "Mall" may temporarily suspend the provision of services in the event of maintenance and inspection of information and communication facilities such as computers, replacement, failure, or loss of communication.
② The "Mall" shall compensate a user or a third party for damages incurred due to the temporary suspension of the provision of services due to the reasons referred to in paragraph (1). Provided, That this shall not apply where the "mole" proves that it is not intentional or negligent.
③ Where it is impossible to provide services due to the conversion of business items, abandonment of business, integration among companies, etc., "Mall" shall notify users in the manner prescribed in Article 8 and compensate consumers according to the conditions originally set forth in "Mall": Provided, That where "Mall" fails to notify the standards for compensation, etc., the mileage, reserves, etc. of users shall be paid to users in kind or in cash equivalent to the currency value used in "Mall".
Article 6 (Membership)
① The user applies for membership registration by filling in the membership information in accordance with the subscription form set by "Mall" and expressing his or her intention to agree to these terms and conditions.
② "Mall" shall be registered as a member unless it falls under any of the following among users who have applied to join as a member as referred to in paragraph (1).
1. Exceptions shall be made where an applicant for membership has previously lost his/her membership pursuant to Article 7 (3) of this Agreement, but where three years have passed since the loss of membership pursuant to Article 7 (3), he/she has obtained consent to rejoin the membership.
2. If there is false, missing, or misrepresentation in the registration content
3. Where it is deemed that registration as a member of other members is significantly hindered by the description of "Mall"
③ The time when the membership contract is established is the time when the consent of the "Mall" reaches the member.
④ If there is a change in the registered matters at the time of membership registration, the member shall notify the "Mall" of the change by means of modification of member information, etc. within a considerable period of time.
Article 7 (withdrawal from membership and loss of qualification, etc.)
① Members may ask "Mall" to withdraw at any time, and "Mall" will handle the withdrawal immediately.
② Where a member falls under any of the following reasons, "mole" may restrict or suspend his/her membership.
1. If false information is registered at the time of application for membership
2. Where the payment of goods, etc. purchased using "Mall" and other debts borne by members in connection with the use of "Mall" are not paid on the due date
3. Threatening the e-commerce order, such as interfering with the use of other people's "mall" or stealing the information
4. Where an act prohibited by a statute or these terms and conditions or contrary to public order and morals is committed by using "Mall"
③ "Mall" may lose its membership if the same act is repeated more than once after suspension, or if the reason is not corrected within 30 days.
④ If "Mall" loses its membership, the membership registration shall be canceled. In such cases, the members shall be notified and the members shall be given an opportunity to clarify at least 30 days before the membership is canceled.
Article 8 (Notification to Members)
① If "Mall" gives notice to the member, it can be done at the e-mail address designated by the member in advance agreement with "Mall".
② In the case of notification to a large number of unspecified members, "Mall" may be replaced by individual notifications by posting them on the "Mall" bulletin board for at least one week: Provided, That individual notifications shall be given to matters that have a significant impact on the member's own transaction.
Article 9 (Purchase Application)
① A user of "Mall" shall apply for a purchase on the "Mall" by the following or similar methods, and "Mall" shall provide the following information in an easy-to-understand manner when a user applies for a purchase.
1. Search and selection of goods, etc
2. Enter recipient's name, address, phone number, e-mail address (or mobile phone number)
3. Confirmation of the details of the terms and conditions, services with limited right to withdraw subscription, delivery fees, installation costs, etc
4. Indication that agrees to these terms and confirms or rejects the provisions of paragraph 3. above (e.g., click on the mouse)
5. Consent to the application for purchase of goods, etc. and the confirmation or confirmation of "mall" thereof
6. Selection of payment method
② Where it is necessary for "Mall" to provide or entrust the purchaser's personal information to a third party, it shall obtain consent from the purchaser at the time of actual purchase application, and shall not obtain comprehensive consent in advance at the time of membership registration. In this case, "Mall" shall specify to the purchaser the items of personal information to be provided, the recipient, the purpose of use of personal information of the recipient, the period of possession and use, etc.: Provided, That if there is any other provision in the relevant Acts and subordinate statutes, such as in the case of entrustment of personal information processing under Article 25 (1) of the Act on Promotion of Information and Communication Network Utilization and Information Protection, etc., it shall be governed by such provisions.
Article 10 (Constitution of Contract)
① The "Mall" may refuse to accept the purchase application as referred to in Article 9 if it falls under any of the following: Provided, That where a contract is concluded with a minor, the minor himself/herself or his/her legal representative shall be notified that the contract may be canceled if he/she fails to obtain the consent of the legal representative.
1. If there is a false, omission, or misspelling in the application content
2. Where a minor purchases goods or services prohibited by the Juvenile Protection Act, such as cigarettes and alcohol
3. Where it is deemed that consenting to other purchase applications is significantly hindered by the "Mall" technology
② The contract is deemed to have been established at the time when the consent of "Mall" reaches the user in the form of a notification of receipt confirmation under Article 12 (1).
③ The expression of the intention to accept "Mall" shall include information on the confirmation and availability of the user's purchase application, cancellation of correction, etc. of the purchase application.
Article 11 (Method of payment)
The payment method for goods or services purchased in the "Mall" may be made by any of the following methods: Provided, That the "Mall" shall not collect any nominal fee in addition to the price of goods, etc. with respect to the user's payment method.
1. Transfer of various accounts such as phone banking, Internet banking, mail banking, etc
2. Payment of various cards such as prepaid, debit, credit card, etc
3. Online bankbook deposit
4. Payment in electronic money
5. Payment upon receipt
6. Payment based on points paid by "Mall" such as mileage
7. Payment by gift certificate signed with "Mall" or recognized by "Mall"
8. Payment by Electronic Payment Method, etc
Article 12 (Notification of receipt confirmation. Change and cancellation of purchase application)
① "Mall" notifies the user of the confirmation of receipt when there is a user's purchase application.
② A user who has received a notice of confirmation of receipt may request the change or cancellation of a purchase application immediately after receiving the notice of confirmation of receipt, etc., and "Mall" shall be processed in accordance with the request of the user before delivery without delay: Provided, That if the payment has already been made, it shall be governed by the provisions of Article 15 on withdrawal of subscription, etc.
Article 13 (Supply of goods, etc.)
① The term "Mall" shall take other necessary measures, such as custom-made, packaging, etc., so that the user can deliver the goods, etc. within seven days from the date of the subscription, unless there is a separate agreement with the user regarding the timing of the supply of the goods, etc. Provided, That where the term "mall" has already received all or part of the price of the goods, etc., measures shall be taken within three business days from the date of receipt of the price in whole or part. At this time, the term "mall" shall take appropriate measures to ensure that the user confirms the procedure and progress of the supply of goods, etc.
② "Mall" shall specify the means of delivery, the person responsible for the delivery cost by means, the delivery period by means, etc. for the goods purchased by the user. If "Mall" exceeds the agreed delivery period, the user shall compensate for the damage caused by it: Provided, That this shall not apply where "Mall" proves that there is no intention or negligence.
Article 14 (refund)
"Mall" shall notify the user without delay if the goods, etc. requested by the user are unable to be delivered or provided due to out of stock, etc., and shall refund or take measures necessary for refund within three business days from the date of receipt of the payment.
Article 15 (Application withdrawal, etc.)
① A user who has entered into a contract with "Mall" for the purchase of goods, etc. may withdraw his/her subscription within seven days from the date of receipt of a document on the contract under Article 13 (2) of the Act on Consumer Protection in Electronic Commerce (referring to the date when goods, etc. are supplied or the supply of goods, etc. began if the document is received later than when the document is received): Provided, That if the withdrawal of the subscription is otherwise provided in the Act on Consumer Protection in Electronic Commerce, etc., the provisions of the same Act shall apply.
② When a user receives goods, etc., he/she shall not return or exchange them in any of the following cases.
1. Where goods, etc. are lost or damaged due to reasons responsible to the user ( provided, however, that if packaging, etc. is damaged to confirm the contents of goods, etc., the subscription may be withdrawn.)
2. Where the value of goods, etc. has significantly decreased due to the use or partial consumption of users
3. Where the value of goods, etc. has significantly decreased to the extent that resale is difficult over time
4. Where the packaging of the original goods, etc. is damaged if it is possible to reproduce with goods, etc. having the same performance
③ In the case of paragraph (2) 2 through 4, the user's withdrawal of subscription shall not be restricted unless the "Mall" is specified in a place where the consumer can easily recognize the restriction of the withdrawal of subscription, etc. or if measures such as providing trial products, etc. are not taken.
④ Notwithstanding the provisions of paragraphs (1) and (2), if the contents of goods, etc. are different from the contents of the display or advertisement or the contents of the contract are fulfilled differently, the user may withdraw the subscription within three months from the date of receipt of the relevant goods, etc., or within 30 days from the date of knowing or knowing the fact.
Article 16 (Effect of subscription withdrawal, etc.)
① The term "Mall" shall refund the price of goods, etc. already paid within three business days when goods, etc. are returned from the user. In such cases, if the term "Mall" delays the refund of goods, etc. to the user, the delayed interest shall be paid by multiplying the delayed interest rate (partial deletion of parentheses) prescribed in Article 21-2 of the Enforcement Decree of the Consumer Protection Act in Electronic Commerce, etc.
② In refunding the above payment, "Mall" requests the business operator who provided the payment method to suspend or cancel the claim for the payment of goods, etc. without delay when the user pays the payment of goods, etc. by means of payment such as credit card or electronic money.
③ In the case of withdrawal of subscription, etc., the user shall bear the expenses necessary for the return of the goods, etc. supplied. "Mall" shall not claim a penalty or compensation for damages to the user for withdrawal of subscription, etc. Provided, That if the contents of the goods, etc. are different from the contents of the display or advertisement, or if the contents of the contract are executed differently from the contents of the contract, "Mall" shall bear the expenses necessary for the return of the goods, etc.
④ If the user pays the shipping cost when receiving the goods, etc., "Mall" clearly indicates who pays the cost when withdrawing the subscription so that the user can easily understand.
Article 17 (Personal Information Protection)
① "Mall" shall collect minimum personal information to the extent necessary for the provision of services when collecting user's personal information.
② "Mall" shall not collect information necessary for the performance of the purchase contract when registering as a member in advance: Provided, That this shall not apply where personal verification is required prior to the purchase contract for the performance of obligations under the relevant Acts and subordinate statutes, and where the minimum amount of specific personal information is collected.
③ "Mall" shall notify the relevant user of the purpose and obtain consent when collecting and using the user's personal information.
④ The "Mall" shall not use the collected personal information for any purpose other than its intended purpose, and where a new purpose of use occurs or is provided to a third party, the relevant user shall be notified of the purpose and consent shall be obtained at the stage of use and provision: Provided, That the foregoing shall not apply where otherwise provided for in the relevant Acts and subordinate statutes.
⑤ Where "Mall" is required to obtain the user's consent pursuant to paragraphs (2) and (3), the person in charge of personal information protection (affiliated, name and phone number, and other contact information), the purpose of collecting and using information, and matters related to the provision of information to a third party (the recipient, the purpose of provision, and the content of information to be provided) shall be specified or notified in advance under Article 22 (2) of the Information and Communication Network Promotion and Information Protection Act, and the user may withdraw his/her consent at any time.
⑥ Users can request permission to view and correct errors of their personal information held by "Mall" at any time, and "Mall" is obligated to take necessary measures without delay. If a user requests correction of an error, "Mall" will not use the personal information until the error is corrected.
⑦ For the protection of personal information, "Mall" shall limit the person who processes the user's personal information to a minimum, and shall be responsible for the loss, theft, leakage, provision, tampering, etc. of the user's personal information, including credit cards, bank accounts, etc.
⑧ "Mall" or a third party who has received personal information from him/her, shall destroy the personal information without delay when the purpose of collecting or receiving the personal information has been achieved.
⑨ "Mall" shall not set the consent box for the collection, use, and provision of personal information as selected in advance. In addition, the service restricted when a user refuses to consent to the collection, use, or provision of personal information shall be specified in detail, and the provision of services, such as membership registration, shall not be restricted or rejected on the grounds that the user refuses to consent to the collection, use, or provision of personal information other than essential collection items.
Article 18 (Obligation of "Mall")
① "Mall" shall not engage in acts prohibited by laws and conditions or contrary to public order and morals, and shall do its best to provide goods and services continuously and reliably as prescribed by these conditions.
② "Mall" should have a security system to protect users' personal information (including credit information) so that users can use Internet services safely.
③ "Mall" is an unfair display prescribed in Article 3 of the Act on the Fairness of Labeling and Advertising with respect to goods or services. If a user suffers damage through advertising, he/she shall be responsible for compensating for such damage.
④ "Mall" does not send advertising e-mails for commercial purposes that users do not want.
Article 19 (Obligation of Members' IDs and Passwords)
① Except in the case of Article 17, the member is responsible for managing the ID and password.
② Members should not allow third parties to use their ID and password.
③ If a member recognizes that his/her ID and password are stolen or used by a third party, he/she shall notify "Mall" immediately and follow the guidance of "Mall".
Article 20 (Obligation of Users)
The user shall not.
1. Registration of false information at the time of application or change
2. Theft of other people's information
3. Change the information posted in "Mall"
4. Transmission or publication of information other than information prescribed by "Mall" (computer program, etc.)
5. Infringement of intellectual property rights, such as "Mall" and other third-party copyrights
6. "Mall" and other acts that damage the reputation of third parties or interfere with their duties
7. Disclosure or posting of obscene or violent messages, images, voices, or other information contrary to public order and morals on the mall
Article 21 (Relationship between "Mall" and "Mall" to be connected)
① If the upper "Mall" and lower "Mall" are connected by a hyperlink (for example, the target of the hyperlink includes letters, pictures, and fairy tales), the former is called a linked "Mall" (website) and the latter is called a linked "Mall" (website).
② The term "Mall" shall not be liable for guarantee if it is specified in the initial screen of the "Mall" or the pop-up screen at the time of connection that the "Mall" is not responsible for guaranteeing transactions made with users by the goods, etc. provided independently by the "Mall".
Article 22 (Restriction on the Attribution and Use of Copyright)
① Copyright and other intellectual property rights for works created by "Mall" belong to "Mall".
② The user shall not reproduce, transmit, publish, distribute, broadcast, or otherwise use the information attributable to the intellectual property rights to the "Mall" from the information obtained by using the "Mall" for profit or make it available to a third party without the prior consent of the "Mall".
③ "Mall" shall notify the relevant user of the use of copyright attributable to the user under the agreement.
Article 23 (Dispute Resolution)
① "Mall" establishes and operates a damage compensation mechanism to reflect legitimate opinions or complaints raised by users and to compensate for such damages.
② "Mall" shall preferentially handle complaints and opinions submitted by users: Provided, That if it is difficult to process promptly, the user shall be notified of the reason and the schedule of processing immediately.
③ In the event of a user's application for damage relief in connection with an e-commerce dispute between the "mole" and the user, it may be subject to mediation by the Fair Trade Commission or a dispute mediation agency commissioned by the Mayor/Governor.
Article 24 (Judicial power and governing law)
① A lawsuit concerning an e-commerce dispute between the "Mall" and the user shall be governed by the address of the user at the time of the complaint, and if there is no address, it shall be under the exclusive jurisdiction of the district court having jurisdiction over the residence: Provided, That if the address or residence of the user is not clear at the time of the complaint or a foreign resident, it shall be filed with the competent court under the Civil Procedure Act.
② Korean law applies to e-commerce litigation filed between "Mall" and the user.
Supplementary Provisions (Effective Date): These terms and conditions shall come into force from MM DD YYYY.
